Maison Polissonne – Elisa LECACHEUR (Sole Proprietorship)

Article 1 – Purpose

These general terms and conditions of sale (hereinafter referred to as "GTC") govern the contractual relationships between:

  • Maison Polissonne, a sole proprietorship managed by Elisa LECACHEUR, whose registered office is located at 29 BOULEVARD JULES FERRY, 75011 PARIS France, registered under the SIRET number 89078092700012,

    and

  • any adult individual (hereinafter referred to as "the Client") making a purchase on the site www.maison-polissonne.com (hereinafter referred to as "the Site").

Any order placed implies the full and unconditional acceptance by the Client of these GTC.

 

Article 2 – Products

The products offered on the Site are erotic and BDSM accessories designed and handcrafted by Elisa and David. Each item is accompanied by a numbered certificate of authenticity.

Some products can be customised at the Client's request.

Warning: These products must be used exclusively between consenting adults, within the framework of an erotic game that respects the human body, safety, and mutual consent.

 

Article 3 – Prices

The prices indicated on the Site are expressed in euros, all taxes included (VAT), excluding delivery charges.

Maison Polissonne reserves the right to change its prices at any time, but products are billed based on the rates in effect at the time of the order.

 

Article 4 – Payment

Payment for orders is made by credit card via the secure service Stripe.

  • Bank details are encrypted and never transmitted in clear text over the network.

  • Maison Polissonne never has access to the Client's bank details.

  • The debit will appear on the Client's bank statement in the name of Elisa LECACHEUR.

The order is considered validated after payment confirmation.

 

Article 5 – Delivery & Discretion

  • The parcels are neutral and discreet, without mention of Maison Polissonne.

  • They are carefully sealed and protected to ensure confidentiality.

  • The Client must provide a complete and accurate address. Any error or omission that prevents delivery shall not engage the responsibility of Maison Polissonne.

  • In case of absence, a delivery notice is left by La Poste for collection at the post office.

The delivery times indicated on the Site are for informational purposes only. Maison Polissonne cannot be held responsible for delays due to strikes, social movements, weather conditions, or any other force majeure.

 

Article 6 – Right of withdrawal & returns

In accordance with the Consumer Code, the Client has a period of 14 days from the receipt of the product to exercise their right of withdrawal.

Important exception: For reasons of hygiene and safety, erotic products cannot be returned if they have been opened, used, worn, or personalised. Only unopened, unused products in their original sealed packaging can be returned.

  • In the case of a compliant return, the refund will be processed within 14 days after receipt of the product.

  • Return shipping costs are the responsibility of the Customer, unless the product is defective.

Article 7 – Warranty

Maison Polissonne products benefit from a legal conformity warranty (articles L217-4 to L217-14 of the Consumer Code) and a warranty against hidden defects (articles 1641 to 1649 of the Civil Code).

In addition to these legal warranties, Maison Polissonne offers a commercial warranty of 12 months against any manufacturing defects.

Excluded are:

  • normal wear and tear,

  • damage caused by improper use or non-compliant use.

In the case of a defective product, Maison Polissonne will cover the return shipping costs.

Article 9 – Liability

  • The photos and descriptions on the Site are for informational purposes only and are not contractual.

  • Maison Polissonne cannot be held responsible for improper use of the products.

  • In the event of force majeure (strike, natural disaster, etc.), the liability of Maison Polissonne cannot be engaged.

 

Article 10 – Intellectual Property

All elements of the Site (texts, visuals, creations, logos, etc.) are the exclusive property of Maison Polissonne and are protected by copyright and intellectual property law.

Any unauthorised reproduction or exploitation may result in legal action.

 

Article 11 – Disputes

These General Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent court will be that of the defendant's place of residence or, at the consumer's choice, that of the place of delivery of the product.

 

Article 12 – Customer Commitment

By validating their order, the Customer declares that they have read and accepted these General Terms and Conditions without reservation.
